Terms and Conditions 1. Purpose and acceptance of the terms and conditions
These Terms and Conditions (hereinafter "TC") define the terms and conditions of access and use of the services offered by Louis Fabre Coaching (hereinafter "the Service Provider"). Any reservation, use of the website, or participation in a session implies the client's full, complete, and unreserved acceptance of these GTC.
2. Nature of services
Louis Fabre Coaching offers high-end services in sports coaching, physical training, wellness, personalized support, and tailor-made programs. The characteristics, content, and prices of the services are freely available on the website and may be modified at any time by the Service Provider without prior notice.
3. Reservations – Terms and conditions and validity
Reservations must be made exclusively via the tools provided or by any means officially accepted by the Service Provider. Packs are valid for six (6) months from the date of purchase. Any sessions not used within this period are permanently lost, with no possibility of postponement or refund.
4. Cancellations and changes to sessions
Any cancellation must be made at least forty-eight (48) hours before the scheduled session. Otherwise, the session will be charged in full and automatically deducted from the pack. Paid sessions are non-refundable and non-exchangeable, except in exceptional cases at the sole discretion of the Service Provider.
5. Health – Mandatory prior information
Before any service, the customer undertakes to provide accurate, complete, and truthful information regarding their health, medical history, current treatments, or any condition that may influence the practice of physical activity. The Service Provider cannot be held liable for any incident resulting from an omission, negligence, or inaccurate statement on the part of the customer.
6. Liability of the Service Provider
The Service Provider shall take all reasonable measures to ensure the safety, professional supervision, and smooth running of the services. However, the Service Provider cannot be held liable in the event of: injuries or damage resulting from improper use of the facilities, failure to follow instructions, accidents attributable to the customer, or personal items lost, stolen, or damaged on the premises. The Service Provider shall only be held liable in the event of gross negligence or proven intentional misconduct.
7. Hygiene, clothing, and use of equipment
The customer undertakes to arrive in clean and appropriate sportswear, with shoes reserved exclusively for indoor use, and in a state of hygiene compatible with a premium environment. The high-end equipment provided must be used in accordance with the Service Provider's instructions. Any damage caused by improper use may result in the customer being charged the full cost of repair or replacement.
8. Intellectual property and content protection
All content, programs, methods, documents, videos, texts, and materials created by Louis Fabre Coaching constitute a work protected by the Intellectual Property Code. Any reproduction, distribution, adaptation, commercial or non-commercial use without prior written authorization is strictly prohibited and may result in legal action.
9. Modification of the general terms and conditions
The Service Provider reserves the right to modify these GTC at any time. The amended versions shall come into force as soon as they are published online and shall be immediately binding on customers.
10. Terms of payment
Services must be paid for in full before the start of the coaching program or any session. In the event of non-payment, the Service Provider reserves the right to suspend or cancel the service without compensation to the customer. Late payment penalties may be applied in accordance with the legislation in force.
11. Delays and punctuality
Each session begins at the scheduled time. Any delay by the client exceeding fifteen (15) minutes entitles the Service Provider to reduce the effective duration of the session or to cancel the session, which remains payable in full.
12. Repeated absences
In the event of late cancellations or repeated absences (three or more occurrences over a two-month period), the Service Provider reserves the right to temporarily or permanently suspend the client's bookings, or to terminate the current package, without refund.
13. Client's behavior and obligations
The client undertakes to behave respectfully towards the Service Provider, the premises, and the equipment. Any inappropriate, disrespectful, dangerous, or contrary to basic rules of etiquette behavior may result in the immediate termination of services and the cancellation of the package, without any refund or compensation being claimed.
14. Termination by the Service Provider
The Service Provider may terminate any coaching relationship in the event of non-compliance with the T&Cs, non-payment, serious damage to equipment, inappropriate behavior or behavior incompatible with the operation of the studio, or endangerment of the client or others. Such termination shall not give rise to any compensation.
15. Force majeure
In the event of an unforeseeable event beyond the Service Provider's control (pandemic, administrative decision, imposed closure, severe weather, inability to access the premises, etc.), services may be suspended, postponed, or adapted. No refunds may be claimed in this regard.
16. Protection of personal data (GDPR)
The data collected by Louis Fabre Coaching is strictly necessary for the management and proper performance of the services. It is treated confidentially and securely. In accordance with the GDPR, the client has the right to access, rectify, oppose, and delete their data upon written request.
17. Confidentiality
All information exchanged between the Service Provider and the client, including personal data, objectives, progress monitoring, programs, and developments, is strictly confidential. The client also undertakes to respect the confidentiality of the methods and content made available to them.
18. Use of images, videos, and testimonials
No image, video, or personal statement from the client may be used for communication or promotional purposes without prior, explicit, and written consent. Louis Fabre Coaching guarantees absolute respect for the privacy and image of its clients.
19. Place of performance of services
Services are mainly provided at the Louis Fabre Coaching private studio. Any sessions held outside or at home may be subject to additional fees, which will be communicated to the client in advance.
20. Non-transferability of packages and sessions
Packages, credits, and services are strictly personal. They may not be assigned, transferred, resold, shared, or refunded. 21. Entire agreement and enforceability These T&Cs constitute the entire agreement between the parties. The possible invalidity of any clause shall not affect the validity of the other provisions.
